The Australian Consumer Law and Your Rights
The Australian Consumer Law (ACL) protects consumers by giving them certain guaranteed rights when they buy goods and services. For example, the ACL requires that goods must be free of defects, and do what they are meant to do. Services must be carried out with care and skill. These rights, which the ACL says automatically apply whenever goods or services are supplied to a consumer, are called ‘Consumer Guarantees’.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and failure does not amount to a major failure.
Consumer Guarantees have no set time limit but generally last for an amount of time that is reasonable to expect given factors including the cost and quality of the product or any representations made.
Nestful Warranty & Refund Policy
1. Warranty Period
- Nestful offers Warranty of 1 year from purchase date for all products sold on our e-commerce site.
2. Warranty Claim
- If you consider that the product which you have purchased under https://www.nestful.com.au is not of a acceptable quality, has a latent defect, or is otherwise not compliant with the conditions, warranties, undertaking, and legal rights given to you under Australian Law (for example, it appears faulty, or does not work at all or proplerly), you can make a claim under this Warranty.Â

3. Warranty Exclusions
- This section identifies what is excluded under this Warranty.
- For the avoidance of any doubt, any and all warranties or conditions which are not guaranteed under the Australian Competition and Consumer Act or, the Australian Competition and Consumer Regulations 2010 and which are not expressly included in this Warranty as additional warranties or conditions are excluded.
- Unless stated otherwise, this Warranty does not extend to loss caused by normal wear and tear, fire, water (liquid spillage or ingression), theft, vermin or insect infestation.
- The exlusion for loss caused by water (liquid spillage or ingression) does not apply to "THE CLASSIC Lamp" and "M3 Table Lamp" except in the circumstances outlined in (3) below.
- This Warranty does not cover water damage to the "THE CLASSIC Lamp" and "M3 Table Lamp" where the water damage was caused by:
- improper closure of the USB covering for "THE CLASSIC Lamp" and "M3 Table Lamp";or
- submersion of "THE CLASSIC Lamp" and "M3 Table Lamp" in water for 30 minutes or more than their IP water & dust rating capabilities; orÂ
- the depth of the water at which "THE CLASSIC Lamp" and "M3 Table Lamp" was submerged than their IP water & dust rating capabilities.
A. This Warranty does not cover damages cuased by:
- Misuse or abusive use of all Nestful products, including physical abuse;
- incorrect operation or not following the operation instructions (as stated in the Product Operational Manual or manufacturer's instructions provided with all Nestful products);
- Improper Installation;
- incorrect or improper maintenance or failure to maintain the Nestful products;
- failure to clean or improper cleaning of the product;
- incorrect voltage or non0authorised electrical connections;
- adverse external conditions such as power surges and dips, thunderstorm activity, acts of God, acts of terrorism, damage caused by vermin, or any other act or circumstance beyond Nestful's control;
- exposure to excessive heat, moisture or dampness;
- exposure to abnormally corrosive conditions;
- use of non authorised/non-standard, defective or incompatible parts;
- repair, modification or other work carried out on the Nestful product other than by Austhorised Nestful Service Personnel.
B. This Warranty does not cover Nesful products puchased in auction or by another third party seller, our products must be purchased through https://www.nestful.com.au with batch number and invoice.
4. Returns & Refund Policy
- Faulty Product Replacements Returns:
- We aim to provide you with products of the highest standard and quality. If you have received a product with a defect, please contact our Customer Service Team as soon as possible, all claims for orders arriving with damaged or wrong items must be made within 7 days from the delivered date, so we can guide you through the Refund or Replacement process and help resolve the problem as swiftly as possible. In order to assist the Refunds and Replacements process, you may be required to send us images of the damage, defect or fault for preliminary assessment. You may be asked to provide further information to support your claim to assist us with our assessment of the goods.
- Nestful needs to be satisfied that the product is faulty, the cause of the fault and that the problem with the goods was not your fault. Nestful reserves the right to have returned goods assessed within a reasonable time frame by the manufacturer to determine this, including whether the goods are defective or simply require some form of basic trouble shooting.
- It is a requirement for the fulfilment of refunds that customers have used their best endeavours to return faulty products complete with the out of the box acessorites supplied at the time of the orginal purchase.
- If the product is confirmed to have a defect, we will replace or refund the price of the product to your original payment method, as appropriate. If the product is confirmed to have a major defect, you are entitled to elect whether you want us to replace or refund the price of the product to your original payment method.

To start a return, you can contact us at info@nestful.com.au. Please note that returns will need to be sent to the following address: 23/2 Slough Ave, Silverwate, 2128, NSW.
If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.
If more than 15 business days have passed since we’ve approved your return, please contact us at info@nestful.com.au.
- We will provide a Refund or Replacement where required to do so by the Australian Consumer Law.
*Please note Under Australian Consumer Law (ACL); consumers are NOT entitled to a repair, replacement or refund under the consumer guarantees if:
- Consumer got what they ordered, but simply change of mind, or decided they didn't like the purchase or had no use for it.Â
- the problem with the product was caused by the consumer misusing it.
